Security Camera Policy

Security cameras are used where needed to provide peace of mind to Library users and staff by discouraging violations of the Library’s policies, to assist Library staff in preventing and following up on policy violations, and, when necessary, to provide law enforcement assistance in prosecuting criminal activity.

This policy covers real-time security video as well as security video recordings.

Commitment to Privacy

Berlin-Peck Memorial Library values patron privacy and is committed to maintaining appropriate confidentiality of its patrons while protecting the public through cooperation with law enforcement. This policy should be interpreted with the understanding that the image of a person on Library property is not protected, but anything that would identify the content of a Library user’s account or borrowing habits is protected and held private.

Location of Security Cameras

Cameras may be installed in indoor and outdoor public spaces where individuals lack a reasonable expectation of privacy. This includes Library entrances and exits, computer areas, play areas, seating areas, aisles, hallways, stairways, delivery areas, and parking lots.

Cameras will not be installed in areas of the Library where individuals have a reasonable expectation of privacy, such as restrooms.

Signage

Signs shall be posted at Library entrances informing the public that security cameras are in use.

Monitoring of Security Cameras

Library staff have access to real-time security video and may randomly or regularly monitor activity. Security video recordings will be viewed in staff-only areas to ensure privacy.

Emergencies

In the event of immediate physical danger, law enforcement officers or agents may be granted immediate access to real-time security video without a subpoena in order to create a safe environment.

Monitoring of Personal Belongings

Because security cameras are not constantly monitored, staff and patrons should take appropriate precautions for the safety and security of their own personal property. Neither the Library nor the Town are responsible for loss of property or personal injury.

Monitoring of Staff Performance

Cameras will not be installed for the purpose of monitoring staff performance.

Retention

Security video recordings will be retained for approximately thirty (30) days, or as determined by the storage capacity of the equipment, which may vary depending on the number and configuration of cameras. As new video is recorded, the oldest video will be automatically deleted.

Access to security video recordings is restricted to Library administration and information technology staff, and only in pursuit of documented incidents of criminal activity or violation of Library policy.

Exported Video Files

Because security recordings are only retained for a limited amount of time, excerpts may be exported to separate video files for long-term storage. These video files are subject to the same privacy requirements outlined in this Security Camera Policy.

Individual and Non-Town Access

Access to security video by patrons, or by any individual who is not currently employed by the Library or Town, is not allowed without a lawful Order of the Court. The Library will refer all requests for access to security video to the Town attorney.

Law Enforcement Access

Police access to security video is allowed only pursuant to a subpoena, court order, or when otherwise required by law, and in exigent situations as stated above. Designated staff will decide if immediate access is necessary in emergency situations.

Posting of Video Stills

In situations involving banned patrons, still images from security video recordings may be shared with Library staff and staff of other libraries. Shared images may remain posted in restricted staff areas for the duration of the banning period. After the ban period ends, these images are archived in the administrative offices for five (5) years.
